The Law
Understanding Drug Possession Charges
This offence is an offence under the Misuse of Drugs Act 1971. It’s one of the most common drug-related offences in the UK.
To prove possession, the prosecution must establish: you had a controlled substance in your possession; you knew you had the substance; you knew (or suspected) it was a controlled drug.
Possession doesn’t just mean having drugs on your person. It can include drugs found in your pockets, bag, or clothing; drugs found in your home, car, or locker; drugs found in a shared space where you have control or knowledge; drugs sent to your address. The key question is whether you had knowledge and control over the drugs.
